SmartMetric Reviewing Legal Options to Enforce Patent Infringement


BAY HARBOR, FL--(Marketwire - March 17, 2009) - SmartMetric, Inc. (OTCBB: SMME) announced today it is reviewing its legal options in enforcing patent infringement action for a patent it holds the exclusive license for from SmartMetric's founder and inventor Mr. Colin Hendrick. The claims in the issued patent in question deal with using any kind of micro chip based card or device to log on to any kind of internet or intranet network.

Mr. Hendrick, speaking from SmartMetric's R&D facility in Bay Harbor, FL, said today that he and the company are holding discussions with two groups of lawyers in California regarding taking enforcement action to uphold all the rights granted in the United States issued Patent. He said he finds it mystifying how companies can blatantly infringe a legal patent without any concern for the rights of its owners.

According to the company, some of the infringers of the Patent in question are very large corporations who have been selling devices and services that have generated multi millions of dollars in revenues globally. These companies have in effect robbed the economic interests of the patents inventor and its license holder and both parties are now taking steps to enforce all rights under United States and International Law.

One of a number of apparent and obvious infringers has built a global business on offering a device that stores log on information on a chip based device that is used around the world in corporations for secure computer and network access. Given a successful enforcement action, this company will owe SmartMetric and its inventor many millions of dollars. And like BlackBerry found, the patent infringers may very well see their core businesses halted by the courts unless the Inventor and SmartMetric agree to license its rights to such third parties.

SmartMetric is the manufacturer of the world's only "inside a credit card" fingerprint scanner that enables biometric activation of credit cards and employee ID and access control cards. Mr. Colin Hendrick is the inventor and holder of a number of important patents dealing with the processes of using chip based devices in security and transaction situations.
